Welcome to VIVA Quinta, a brand of Musas Encantadoras Lda (a Portuguese limited company). These Terms of Service ("Terms") govern your use of our website at vivaquinta.com and any services we offer through it. By visiting our website, signing up for our Private Guest List, sending us an inquiry, or making a booking, you agree to these Terms.

1. Who we are

2. Use of our website

You may use our website for lawful purposes only. You agree not to:

• Use the website in any way that breaches applicable laws or regulations
• Use the website to send unsolicited commercial communications
• Attempt to gain unauthorized access to the website, our servers, or any connected systems
• Introduce viruses, malware, or other harmful code
• Reproduce, duplicate, copy, sell, or resell any part of the website without our written permission
• Use automated systems (bots, scrapers, etc.) to access the website without our consent

We reserve the right to deny or restrict access to anyone who violates these Terms.

3. Bookings and reservations

3.1 Booking process

Reservations may be made through our website (via inquiry forms), by email, or through approved booking platforms we partner with. A booking is not confirmed until we issue a written confirmation and receive any required deposit.

3.2 Rates and inclusions

Published rates are per stay or per night as indicated. Rates include applicable Portuguese VAT and the inclusions specified at the time of booking (e.g., farm breakfast). Tourist tax, optional experiences, gratuities, and incidentals are not included unless explicitly stated.

3.3 Deposits and payment

A deposit may be required to confirm your booking. The balance is due as specified in your confirmation. We accept payment in EUR (€). Payment processing is handled by third-party processors; we do not store full payment card details.

3.4 Cancellation and refunds

Our cancellation policy will be communicated at the time of booking and forms part of your booking agreement. In general:

• Cancellations more than 30 days before arrival: full refund minus any non-refundable booking fees
• Cancellations 14–30 days before arrival: 50% refund
• Cancellations less than 14 days before arrival: no refund
• No-shows: no refund

Specific stays, packages, retreats, weddings, or holiday-period bookings may have different policies, which will be clearly stated before you confirm. We strongly recommend purchasing travel insurance.

3.5 Modifications

Requests to modify your booking (dates, guest count, room type) are subject to availability and may incur a rate change. We will do our best to accommodate reasonable requests.

3.6 Force majeure

Neither party is liable for failure to perform due to circumstances beyond reasonable control, including natural disasters, acts of government, pandemics, civil unrest, transportation disruptions, or volcanic activity in the Azores. In such cases, we will offer to reschedule your stay or provide a credit valid for 18 months.

4. Conduct at the property

When you stay with VIVA Quinta, you agree to:

• Treat the property, its land, animals, plants, and staff with respect
• Follow safety guidance from staff at all times
• Comply with our published house rules (provided at check-in)
• Not exceed the registered guest count without prior written approval
• Not host events, parties, or commercial activities at the property without prior written approval
• Be responsible for any damage to the property or surrounding land caused by you or members of your party
• Refrain from smoking inside the buildings
• Keep pets only where explicitly permitted by your booking

Musas Encantadoras Lda reserves the right to refuse service, end a stay early without refund, or recover damages for serious violations.

5. Experiences, retreats, and on-property activities

Farm tours, cooking classes, workshops, wellness experiences, retreats, and other activities are subject to availability, weather, and minimum participant requirements. We reserve the right to cancel, reschedule, or substitute an experience and offer you a full refund or alternative if we cannot proceed as planned.

Some experiences involve physical activity, contact with farm animals, or use of farm equipment. You are responsible for assessing your own ability to participate safely and for disclosing any relevant medical conditions or allergies in advance.

6. Intellectual property

All content on this website — including text, photography, illustrations, video, the VIVA Quinta name and logo, and the overall design — is owned by Musas Encantadoras Lda or licensed to us. You may not reproduce, distribute, modify, or use any content for commercial purposes without our prior written permission.

You may share links to vivaquinta.com and quote short excerpts with attribution.

If you tag VIVA Quinta in social media posts featuring your stay, you grant us a non-exclusive, royalty-free license to reshare your content with attribution on our social channels and website. You can revoke this license at any time by contacting us.

7. User-submitted content

If you submit reviews, photos, comments, or other content through our website, social channels, or guest communications, you confirm that:

• You own the content or have permission to share it
• The content is accurate and not misleading
• The content does not violate the rights of any third party
• The content is not unlawful, defamatory, hateful, or harmful

We may moderate, edit, or remove user content at our discretion.

8. Third-party links and services

Our website may link to third-party services (e.g., booking platforms, payment processors, social media). We are not responsible for the content, accuracy, or privacy practices of third-party sites. Your interactions with them are governed by their own terms and policies.

9. Disclaimers and limitation of liability

9.1 Website

Our website is provided "as is" and "as available." We do not guarantee uninterrupted access, freedom from errors, or that the website will be free from viruses or other harmful components.

9.2 Information accuracy

We strive to keep all information about the property, rates, experiences, and availability accurate, but we do not warrant that everything on the website is current at all times. Final terms of your stay are governed by your booking confirmation.

9.3 Limitation of liability

To the fullest extent permitted by law, Musas Encantadoras Lda is not liable for indirect, incidental, consequential, or punitive damages arising from your use of the website or your stay, except where caused by our negligence or willful misconduct. Our total liability for any claim shall not exceed the total amount you have paid us in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Portuguese or EU consumer protection law.

10. Indemnification

You agree to indemnify and hold Musas Encantadoras Lda harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the website, or your conduct at the property.

11. Governing law and disputes

These Terms are governed by the laws of Portugal. Any dispute arising from these Terms or your stay will be subject to the exclusive jurisdiction of the courts of Ponta Delgada, Azores, Portugal, except where mandatory consumer protection laws of your country of residence provide otherwise.

EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr for out-of-court resolution.

Portuguese consumers may refer disputes to the consumer arbitration center of the Azores: Centro de Arbitragem de Conflitos de Consumo dos Açores.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted to this page with an updated "Last updated" date. If you have a confirmed booking when we change the Terms, the version in effect at the time of your booking will continue to apply to that booking.
