Experience Terms

These Experience Terms apply to public and guest experiences offered by VIVA Quinta, including Harvest, Cook & Dine at VIVA Quinta, the VIVA Quinta Sunset Farm Experience with Farm-to-Table Dinner, and other farm, culinary, dining, or educational experiences that we may offer from time to time.
By making a booking, providing payment details, attending an experience, or participating in any activity at VIVA Quinta, each participant agrees to these Experience Terms, together with any specific details shown at the time of booking.
1. Nature of the experience
VIVA Quinta is a working farm. Our experiences take place in an active agricultural environment and may involve walking on uneven ground, exposure to weather, contact with plants, food preparation areas, tools, farm infrastructure, animals, outdoor surfaces, and other ordinary features of a farm setting.[web:84][web:86][web:92]
Participants must understand that farm and culinary experiences involve inherent risks that cannot be entirely eliminated without changing the essential nature of the activity.[web:85][web:88][web:107]
2. Booking and payment
All experience bookings must be paid in full at the time of booking. A place is confirmed only once payment has been successfully received.[web:102][web:103]
Bookings are personal to the participant or booking party and may not be transferred, resold, or reassigned without prior written approval from VIVA Quinta.
3. Cancellations, no-shows and cancellations by VIVA Quinta
Cancellations made more than 72 hours before the scheduled start of the experience are eligible for a full refund.[web:95][web:98]
Cancellations made 72 hours or less before the scheduled start time are non-refundable. Participants who do not attend their booked experience, or who arrive too late to participate, will be treated as no-shows and charged in full.[web:94][web:98][web:102]
Experiences operate rain or shine and are not subject to rescheduling due to ordinary weather conditions.[web:100][web:102][web:107]
If VIVA Quinta must cancel an experience for any reason, including operational, staffing, safety, or other circumstances, participants will receive a full refund of the amount paid for that experience.[web:102][web:103][web:106]
4. Arrival and punctuality
Participants are responsible for arriving on time and being ready to begin at the scheduled start time. Experiences often follow a set format and may begin promptly.
Late arrival may reduce or prevent participation, especially where safety briefings, guided movements through the farm, or timed culinary elements are involved. In such cases, no refund or credit will be due.
5. Children and supervision
Children are welcome on all farm tours but must remain under the close supervision of a parent, guardian, or responsible adult at all times.[web:100][web:107][web:108]
Children may participate in cooking classes only if they are 13 years of age or older. Any participant under 18 remains the responsibility of their parent or guardian at all times.
VIVA Quinta reserves the right to refuse participation where a child cannot safely take part in the activity or where adequate supervision is not provided.
6. Safety and participant conduct
All participants must follow instructions given by VIVA Quinta staff, guides, chefs, and service providers at all times.[web:85][web:87][web:107]
Participants must remain within designated visitor areas unless expressly invited elsewhere by staff. Entry into restricted zones, operational areas, animal enclosures, greenhouses, storage spaces, machinery areas, kitchens, or staff-only areas is not permitted unless specifically authorized as part of the experience.[web:86][web:107]
Unsafe, disruptive, abusive, intoxicated, or inappropriate behavior is not permitted. VIVA Quinta may remove any participant from the experience without refund where conduct creates a risk to people, animals, property, or the experience environment.[web:103][web:107]
7. Clothing and footwear
Participants must wear clothing and footwear suitable for a working farm and culinary environment.[web:101][web:102][web:107]
We strongly recommend closed-toe shoes with good grip and practical clothing suitable for weather, walking, outdoor surfaces, and proximity to plants, tools, and food preparation areas.[web:101][web:102]
VIVA Quinta may refuse participation, without refund, where footwear or clothing is unsafe or unsuitable for the specific experience.
8. Food, allergies and dietary restrictions
Participants must inform VIVA Quinta in advance of any relevant food allergies, intolerances, dietary restrictions, or medical conditions that may affect safe participation in a culinary or dining experience.[web:82][web:85][web:88]
We will make reasonable efforts to accommodate disclosed dietary needs where possible. However, because our experiences may involve shared preparation spaces, ingredients, and equipment, we cannot guarantee a completely allergen-free environment.[web:82][web:87][web:88]
Participants remain responsible for deciding whether they can safely consume food or take part in any cooking, tasting, or dining element of the experience.
9. Alcohol service
Alcohol may be served as part of certain experiences. Where alcohol is offered, participants are expected to consume responsibly.
VIVA Quinta reserves the right to refuse alcohol service to any participant who appears intoxicated, underage, unsafe, disruptive, or otherwise unsuitable to be served alcohol.[web:103]
Participants must comply with all applicable laws regarding alcohol consumption. Proof of age may be requested where appropriate.
10. Photography, video and commercial content
Participants are welcome to take personal photos and personal videos for private use during the experience, provided this does not disrupt the activity, staff, animals, or other participants.
Commercial filming, professional photography, influencer content creation, branded content production, promotional shoots, stock photography, or other business-related recording is not allowed unless approved in writing by VIVA Quinta in advance.
Participants must respect the privacy of others and should not record or publish identifiable images of other guests, staff, or private areas without appropriate permission.
11. Personal property
Participants are responsible for their own personal belongings during the experience. VIVA Quinta is not responsible for loss of or damage to personal property except where liability cannot be excluded by law.
12. Health, risk and liability
By participating, each participant acknowledges that farm, culinary, and outdoor hospitality experiences may involve inherent risks, including slips, trips, falls, cuts, burns, animal-related risks, weather-related discomfort, food-related reactions, and other ordinary risks associated with a working farm and active cooking environment.[web:85][web:88][web:89][web:107]
Participants agree to take reasonable care for their own safety, to follow instructions, and not to engage in conduct that may place themselves or others at risk.[web:85][web:107]
To the fullest extent permitted by applicable law, VIVA Quinta is not liable for injury, loss, damage, delay, or inconvenience arising from ordinary risks inherent in the experience, from participant failure to follow instructions, or from inaccurate or incomplete health, dietary, or allergy information provided by the participant.[web:85][web:88][web:108]
Nothing in these Experience Terms excludes or limits any rights that cannot be excluded under applicable consumer protection or liability law.
13. Privacy and data
Personal data collected in connection with booking or attending an experience, including contact details, payment status, dietary information, allergy information, and operational communications, will be handled in accordance with the applicable VIVA Quinta privacy policy made available at the time of booking.[web:40][web:41][web:46]
Participants should provide only the personal or health-related information reasonably necessary for safe participation and service delivery.
14. Changes to experiences
VIVA Quinta may reasonably modify the route, sequence, menu, duration, provider, or specific content of an experience where necessary because of ingredient availability, seasonal conditions, farm operations, staffing, safety, animal welfare, or other operational reasons.[web:102][web:107]
Such modifications do not entitle participants to a refund unless VIVA Quinta cancels the experience entirely.
